1. Introduction

a. The loyalty card scheme hereafter known as ‘the Scheme’ rewards members with points redeemable as vouchers when they make qualifying purchases at TORWOOD GARDEN CENTRE LTD.

b. These terms and conditions hereafter known as ‘the Conditions’ set out the terms on which you can join the scheme, earn points and convert these points into reward vouchers to spend at TORWOOD GARDEN CENTRE LTD. These are also the terms relating to data protection.

c. If you join the Scheme or use a reward card, you automatically accept these Conditions.

2. Joining the Scheme and using your Card

a. Your name, full postal address, email address, date of birth and date of birth and signature must be provided for a Card to be registered. Applicants must be aged 16 or over and must have a resident UK, Channel Island or Isle of Man address.

b. Your Card is issued by, and remains the property of, the Scheme. It must be returned to the Scheme on request or destroyed when no longer valid for use.

c. If you do not register your Card you will not become a member or be able to redeem your points nor will you be eligible for other Scheme offers and promotions from time to time.

d. If the Scheme reasonably believes that you have breached these Conditions and/or abused the Scheme, Cards may be terminated without prior notice.

e. The Scheme also reserves the right to: (a) stop issuing Cards at any time; (b) on notice to you, alter or amend these Conditions; and (c) on notice to you, amend, withdraw or cancel the Cards and/or the points and/or terminate the Scheme. We may close your account if sufficient points have not been earned for 18 months or if the Card has not been used for 18 months or more.

f. You may terminate your Card at any time in which case all points on the Card and vouchers issued shall be lost.

g. You are responsible for the security of your Card and all vouchers. If you believe an unauthorised person has compromised your Card, notify TORWOOD GARDEN CENTRE LTD immediately. Lost, damaged or stolen Cards can be replaced by visiting us. The Scheme is not responsible for any unauthorised use of the Card or lost or stolen vouchers.

h. A Card and any points on it are non-transferable, and can only be used by the registered cardholder

i. Only one membership per household. We reserve the right to refuse, merge or close additional accounts at any time.

k. The Scheme is not open to employees of TORWOOD GARDEN CENTRE LTD.

3. Points and reward vouchers

a. To collect points, you must present your Card at the till at the time of purchase or within 30 days of the date of purchase (with validated till receipt). You cannot claim points on purchases made before you joined the Scheme.

b. Points may be redeemed against all merchandise sold in TORWOOD GARDEN CENTRE LTD, with the exception of food, pet food, fuel, gift vouchers and sales in Blossoms Restaurant and Rousay’s Cafe.

c. Product discounts related to the Scheme are not valid for redemption against the excepted merchandise noted in Section 3b.

d. You will receive a voucher for 5% of your qualifying spend. These rates can be altered at the Scheme’s discretion on reasonable notice given via post, email or our website.

e. The Scheme reserves the right to offer bonus points on certain products from time to time at its sole discretion.

f. The Scheme reserves the right to terminate any points offers at its sole discretion, with as much notice as reasonably practicable.

g. All points awarded and all mailing vouchers issued have no monetary value.

h. Several times a year we will arrange for you to be sent your printed vouchers — either via email or post — corresponding to your points balance at the time of the mailing extract. Vouchers will only be issued if you have a qualifying balance of £1.00. The Scheme shall not be responsible for vouchers lost in the post or not received by email.

i. The Scheme is entitled to vary the qualifying points balance and number of mailings per year from time to time, with reasonable notice.

j. Vouchers will have an expiry date specified on them and be subject to any other terms stated on the voucher.

k. If the Scheme reasonably suspects abuse, fraud or misconduct, it may refuse to issue and/or cancel points or vouchers.

l. Vouchers are personal to you, non-transferable and cannot be exchanged for cash.

m. Unless otherwise stated, promotional vouchers are valid for 2 months from date of publishing, against all merchandise sold in TORWOOD GARDEN CENTRE LTD except food, pet food, fuel, gift vouchers and sales in Blossoms Restaurant and Rousay’s Cafe.

n. Promotional vouchers cannot be used after the expiry date, have no cash value, are non-refundable and non-exchangeable. Only one promotional voucher can be redeemed per transaction. Valid on full price items only.

4. General Terms

a. The Scheme may vary these Conditions and will give Cardholders as much notice as it reasonably can, including via post, email or our website.

b. Cardholders should check our website and these Conditions frequently to ensure they are aware of any changes.

c. If the Scheme decides to transfer the Scheme to another legal entity, it may transfer all of its rights and obligations under these Conditions Any transferee will be required to comply with these Conditions and applicable data protection law. We will notify Cardholders in advance of any such transfer that affects how your personal data is used.

d. The Scheme will not be liable to Cardholders for losses suffered by Cardholders. This limit does not exclude or limit the Scheme’s liability for death or personal injury caused by its negligence.

e. The Scheme and Cardholders’ rights and obligations under these Conditions and any dispute in relation to them shall be governed by Scots law and heard to the exclusion of all other forums in the Scottish courts.

5. Data Protection

a. Data Controller. Under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, your data controller is TORWOOD GARDEN CENTRE LTD (SC092609), Central Park, Bellsdyke Road, Larbert FK5 4EG. b. What personal information we collect

i. Information that you provide when completing your Reward Card application on our website or in-store (including your name, date of birth (optional — see Section 5c(vii)), postal address, email address and telephone number);

ii. Information relating to your membership of the Scheme, including your Reward Card.

iii. Information that you provide for the purpose of subscribing to our email notifications (you can unsubscribe at any time by clicking the unsubscribe link in any email);

iv. When you use your Reward Card to shop with us, transaction information including purchases you earn points for and how you use your Reward Card vouchers within TORWOOD GARDEN CENTRE LTD;       

v. Any other personal information that you choose to send to us.

c. How we will use your personal information

i. We use your personal data for the following purposes, each with the lawful basis stated:

ii. To organise and administer the scheme, your application and your account. Lawful basis: performance of a contract (UK GDPR Art 6(1)(b)).

iii. To use your telephone number for delivery logistics (including matching your details on delivery notes generated through our till system) and to contact you where we need to verify or correct other details we hold for you, for example where an email address you have given us does not work. We do not use your telephone number for telephone or SMS marketing. Lawful basis: performance of a contract and legitimate interests (UK GDPR Art 6(1)(b) and (f)).

iv. To send you your earned reward vouchers and administrative information about the Scheme. Lawful basis: performance of a contract (UK GDPR Art 6(1)(b)). Note: opting out of marketing does not cancel your scheme membership — these are separate.

v. To send you non-marketing service communications. Lawful basis: legitimate interests (UK GDPR Art 6(1)(f)).

vi. To send you goods purchased through our website, in-store or by phone. Lawful basis: performance of a contract (UK GDPR Art 6(1)(b)).

vii. To deal with enquiries and complaints. Lawful basis: legitimate interests (UK GDPR Art 6(1)(f)).

viii. Where you optionally provide your date of birth and consent to receive a birthday reward, to send you a birthday voucher by post or email. Providing your date of birth is entirely optional. You may withdraw this consent at any time by emailing rewards@torwoodgardencentre.co.uk. Lawful basis: consent (UK GDPR Art 6(1)(a)).

ix. Email marketing: where you opt in, to send you marketing communications about TORWOOD GARDEN CENTRE LTD’s products and promotions by email. You may opt out at any time by clicking the unsubscribe link in any email or by emailing rewards@torwoodgardencentre.co.uk. Lawful basis: legitimate interests, relying on the soft opt-in for existing customers (PECR Regulation 22(3) / UK GDPR Art 6(1)(f)). Postal marketing: where you opt in, to send you marketing communications by post. You may opt out at any time by emailing rewards@torwoodgardencentre.co.uk or calling 01324 553152. You have the right to object to postal marketing at any time. Lawful basis: legitimate interests (UK GDPR Art 6(1)(f)).

x. We will not sell your personal data to any third party. We may share your data with trusted partners who help us operate the Reward Card scheme (including scheme administration, data management and mailing services). These partners process your data only on our instructions, for the purposes of running the scheme, and are contractually required to protect it. Your data will not be used by these partners for their own marketing purposes.

d. Retaining Personal Information

We will hold your personal data for as long as your Reward Card membership is active. If you cancel your membership, or if your account is closed due to inactivity under Section 2e, we will retain your data for up to 2 years thereafter for administration and legal purposes, after which it will be deleted or anonymised. e. Security of Personal Information

Security of Personal Information. Your personal data shall be held and stored on secure and encrypted computers. The Scheme confirms that it has appropriate technical and organisational security measures in place to keep your personal information safe and secure in accordance with UK GDPR.

f. Your Rights. Under UK GDPR you have the following rights regarding your personal data:

• Right of access — to request a copy of the personal data we hold about you;
• Right to rectification — to ask us to correct inaccurate data;
• Right to erasure — to ask us to delete your data in certain circumstances;
• Right to restriction — to ask us to limit how we use your data;
• Right to data portability — to receive your data in a structured, machine-readable format;
• Right to object — to object to our use of your data for direct marketing at any time. This right is absolute and we must comply immediately.
• Right to withdraw consent — where we rely on consent, you can withdraw it at any time without affecting prior processing.

To exercise any of these rights, please email rewards@torwoodgardencentre.co.uk. We will ask you to confirm your identity by providing your name, email address, and one additional detail (such as your date of birth or reward card number). We will respond within one month.

1113. Right to Complain. If you are unhappy with how we handle your personal data, you have the right to lodge a complaint with the UK Information Commissioner’s Office (ICO) at ico.org.uk or by calling 0303 123 1113.
